A group of small manufacturing companies has been lobbying for such a rule for years. They feel that because the larger companies have the financial muscle to provide free samples on a large scale, it gives them an unfair advantage in the market place.
At first glance you would think that such a bill would not have a chance of being passed, but apparently, the free sample ban is almost hidden by the other, more sensible, provisions of the bill. The overall thrust of bill 4104 which in entitled Act for Partial Rectification of Inequities of Law which Facilitate Overly Onerous Leverage of Size is to level the playing field for small manufacturers.
The problem is that because it does contain some very good measures to help small businesses, this bill has a good chance of passing without Congress even noticing the ridiculous free sample restriction. If we are to have any chance of stopping this legislation is imperative that you contact your representatives and let them know that the free sample restrictions must not be allowed to pass.
